2 Purpose
These Terms of Service (hereinafter "ToS") define the terms and conditions for using the Site as well as the rights and obligations of Users.
Any registration or use of the Site implies unreserved acceptance of these ToS. If you do not accept these conditions, you must not use the Site.
3 Access to Service
The Site is freely accessible to any User with Internet access. All costs related to accessing the Site (computer equipment, Internet connection, etc.) are the sole responsibility of the User.
AVYGEO uses all reasonable means to ensure continuous access to the Site, without however guaranteeing permanent availability. Access to the Site may be interrupted at any time for maintenance, updates or any other technical reason.
AVYGEO reserves the right to modify, suspend or discontinue access to all or part of the Site at any time, without notice or compensation.
4 User Account
To access certain features of the Site (posting reviews, comments, messaging, etc.), the User must create an account by providing accurate and complete information. The User agrees to update this information if it changes.
The User is solely responsible for the confidentiality of their login credentials and all activities carried out from their account. In case of fraudulent use of their account, the User must immediately inform AVYGEO.
AVYGEO reserves the right to suspend or delete any User account in case of violation of these ToS, without notice or compensation.
5 User-Generated Content
The Site allows Users to publish various types of content: reviews, comments, messages, profile photos (hereinafter "User Content").
Code of Conduct
The User agrees not to publish Content that:
- violates applicable laws and regulations (including defamatory, insulting, discriminatory content, or content inciting hatred or violence)
- infringes third-party intellectual property rights (protected images, copied texts without authorization, etc.)
- is pornographic or manifestly contrary to public morals
- violates the privacy or image rights of third parties
- constitutes harassment or intimidation
- contains false or misleading information
- is unauthorized advertising or promotional content
User Warranties
By publishing Content on the Site, the User warrants that they hold all necessary intellectual property rights or have obtained all required authorizations for such publication. The User indemnifies AVYGEO against any claim, complaint or demand from third parties relating to Content they have published.
License Grant
By publishing Content on the Site, the User grants AVYGEO a non-exclusive, free, worldwide license for the legal duration of intellectual property protection, allowing it to reproduce, represent, adapt and distribute this Content as part of the Site's operation.
6 Content Hosting Status
In accordance with Article 6 of French Law No. 2004-575 of June 21, 2004 on confidence in the digital economy (LCEN), AVYGEO acts as a host of User Content published on the Site.
As such, AVYGEO is not subject to a general obligation to monitor User Content and does not exercise prior editorial control over it.
AVYGEO cannot be held responsible for User Content published on the Site, for which the authors remain solely responsible. However, AVYGEO commits to promptly removing any manifestly illegal Content that is notified to it in the forms provided by law.
7 Illegal Content Notification Procedure
In accordance with Article 6-I-5 of the LCEN, any person may notify AVYGEO of Content they consider illegal in order to obtain its removal.
To be admissible, the notification must include the following elements:
- The date of notification
- The identity of the notifier (surname, first name, address for an individual; company name, registered office and legal representative for a legal entity)
- A precise description of the disputed facts and their exact location on the Site (URL)
- The reasons why the Content should be removed, including reference to the legal or contractual provisions concerned
- A copy of correspondence sent to the Content author requesting removal, or justification for the impossibility of contacting the author
- A sworn statement attesting to the accuracy of the information provided

8 Intellectual Property
The Site and all its elements (trademarks, logos, texts, structure, design, database, functionalities, source code, etc.) are the exclusive property of AVYGEO or are subject to a license of use.
Any reproduction, representation, modification, distribution or exploitation of all or part of the Site, by any means whatsoever, without the prior written authorization of AVYGEO, is strictly prohibited and constitutes infringement punishable under intellectual property law.
Information relating to works referenced on the Site (titles, cover images, descriptions, etc.) is used for informational and critical purposes, in accordance with the right of quotation.
9 Personal Data
AVYGEO collects and processes personal data as part of the use of the Site, in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act.

10 Liability
AVYGEO strives to provide information that is as accurate as possible. However, it cannot be held responsible for omissions, inaccuracies or deficiencies in updating the information available on the Site.
AVYGEO disclaims any liability for direct or indirect damages resulting from the use of the Site, including service interruption, presence of viruses or any other harmful element.
Hyperlinks on the Site may lead to third-party sites over which AVYGEO has no control. AVYGEO cannot be held responsible for the content of these external sites.
The User is solely responsible for their use of the Site and the Content they publish. They agree to indemnify AVYGEO for any damage resulting directly or indirectly from violation of these ToS.
11 Modifications to the ToS
AVYGEO reserves the right to modify these ToS at any time. Users will be informed of modifications by any appropriate means (notification on the Site, email, etc.).
Continued use of the Site after modification of the ToS constitutes acceptance of the new conditions. If the User does not accept the modifications, they must stop using the Site and delete their account.
12 Applicable Law and Jurisdiction
These ToS are governed by French law.
In case of dispute relating to the interpretation or execution of these ToS, the parties will endeavor to find an amicable solution. Failing agreement, the dispute will be brought before the competent courts of Paris.
13 Affiliate Links and Disclosures
TomeHero is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to amazon.com and its international variants (amazon.fr, amazon.de, amazon.es, etc.). As an Amazon Associate, TomeHero earns from qualifying purchases.
TomeHero may also participate in other affiliate programs with retail and streaming partners (Apple, Fnac, Cultura, Bookshop.org, Steam, GOG, Netflix, Apple TV, Prime Video, Disney+, etc.). When a User clicks an outbound link to a partner and completes a purchase, subscription or other qualifying action, TomeHero may receive a commission at no additional cost to the User.
These commissions help fund the editorial and technical operation of the Site. They never influence our editorial choices, our reviews or the rankings displayed: the selection of works featured on TomeHero is independent of any commercial relationship with a partner. Reviews and ratings are written by Users and editors based solely on the merit of each work.
Outbound links to partners open in a new browser tab. Once a User leaves TomeHero, they are subject to the partner's own terms of service, privacy policy and data collection practices, over which TomeHero has no control.
